Our Litigation department deals with disputes that arise in ordinary course of business and individual relationships. Our wide scope of litigation ranges from personal claims, insurance law, constitutional law, land ownership disputes, election petitions, employment and labour disputes, bankruptcy and insolvency. We appear before different courts, tribunals and quasi–judicial tribunals to protect our clients’ rights. We specialize in the following fields;

INSURANCE CLAIMS: We represent multiple insurance firms in policy enforcement, recoveries and material damage claims under the principle of subrogation as well as defend them against personal injury claims. We are actively involved in negotiations that would make business sense to our clients by either securing a concession on liability or securing favorable terms on quantum thus saving them foreseeable escalated costs.

MEDICAL NEGLIGENCE CLAIMS: The firm has successfully established a niche in this area. We have and continue to represent medical practitioners and institutions as well as individuals at the Kenya Medical Practitioners and Dentists Board and in court. We have been successful in our arguments at the Medical Board which were subsequently escalated and upheld at the High Court and the Court of Appeal.

BANKING AND SECURITIES: Over the years we have maintained a seat in the panel in over ten (10) national and multinational banks where we, coupled with our Conveyancing department, offer our expertise in disputes arising from banking transactions and contracts between banks and third parties.

ENVIRONMENT AND LAND DISPUTES: The team handles disputes pertaining to ownership of land and property at the National Land Commission and court. We safeguard our client’s proprietary rights.

ELECTION PETITIONS AND CONSTITUTION PETITIONS: In the last election cycle, our team successfully represented the Electoral Commission in the Presidential, Gubernatorial and Parliamentary Petitions. We have also successfully represented various electives and provided legal advisory on issues arising during their term in office.

EMPLOYMENT AND LABOUR LAWS: We pride ourselves in drafting and enforcing terms existing between employee and employer and addressing the disputes arising therefrom through alternative disputes resolution and litigation. Among others, the firm is currently representing a leading bank in a class action suit arising from Early Retirement Scheme.
