A STERN WARNING AGAINST THE USE OF SCHOOL BUSES FOR PRIVATE EVENTS: THE CASE OF OLD MUTUAL GENERAL INSURANCE KENYA LIMITED V BOARD OF DIRECTORS, ODER BOYS BOARDING SPECIAL SCHOOL

It is a common occurrence in Kenya for local communities to hire school buses to ferry them as they attend various private events. This, however, raises a crucial question as to whether in the unlikely event that an accident occurs during these events, the insurance company would be liable to settle the ensuing claims.

The High Court delivered a landmark judgment on 8th August 2024, which is of contemporary
legal importance and interest. The High Court Judge held that those who hire school buses for transport to crusades, weddings or funerals are not entitled to be compensated by the Insurance Company which has insured the bus in the event of accidents. The Judge directed that all schools in the country be notified of this judgment.
